In accordance with the Digital Millennium Copyright Act of 1998 (17 U.S.C. § 512) ("DMCA"), RapidRoomz maintains an active DMCA Safe Harbor policy to respond promptly to valid claims of alleged copyright infringement on our online accommodation platform.
If you believe in good faith that any photograph, room image, hotel logo, property description, or media hosted on RapidRoomz infringes your copyrighted work, you or your authorized agent may submit a formal DMCA Takedown Notice to our Designated Copyright Agent.

3 Requirements for Submitting a Valid DMCA Notice
Under 17 U.S.C. § 512(c)(3), to be effective, a DMCA Takedown Notice must be a written communication provided to our Designated Agent that includes substantially all of the following details:
- Signature: A physical or electronic signature of the person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
- Identification of Copyrighted Work: Identification of the copyrighted work claimed to have been infringed (or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works).
- Identification of Infringing Material: Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit RapidRoomz to locate the material (including specific URLs on rapidroomz.com).
- Contact Information: Information reasonably sufficient to permit RapidRoomz to contact you, such as an address, telephone number, and, if available, an email address.
- Good Faith Belief Statement: A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- Perjury & Accuracy Statement: A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
4 Takedown Procedure & Host Notification
Upon receipt of a complete and valid DMCA Notice, RapidRoomz will take the following actions:
- Expeditiously remove or disable access to the allegedly infringing material on our website and mobile platforms.
- Notify the property host, partner, or user who uploaded the material that access has been disabled.
- Provide the uploading host with a copy of the DMCA Notice so they may submit a Counter-Notification if they believe the material was removed by mistake or misidentification.
5 Counter-Notification Procedure (17 U.S.C. § 512(g)(3))
If a property host or user believes that content was removed or access was disabled as a result of mistake or misidentification, a written Counter-Notification may be sent to our Designated Agent containing:
- The host’s physical or electronic signature.
- Identification of the material that has been removed or to which access has been disabled, and the location (URL) at which the material appeared before it was removed.
- A statement under penalty of perjury that the host has a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
- The host’s name, address, and telephone number, and a statement that the host consents to the jurisdiction of the Federal District Court for the judicial district in which the address is located (or New Mexico, USA if outside the US), and will accept service of process from the person who provided the original DMCA notice.
If a valid Counter-Notice is received, RapidRoomz may restore the material within 10 to 14 business days, unless the original copyright owner files a court action seeking a judicial order against the user.
6 Repeat Infringer Policy
RapidRoomz maintains a strict repeat infringer policy. In accordance with 17 U.S.C. § 512(i), any property host, account holder, or registered partner who is determined to have repeatedly uploaded infringing photos or unauthorized property content will have their account privileges permanently revoked and their listings terminated from the RapidRoomz marketplace.
